Even though WebBusiness provides you with web based email access, it is always a good idea to maintain the usage or option of other email programs, ie. Outlook or other email retrieval programs to access email. It is also suggested that you have an alternate email address for your correspondence in the event of mail server problems. We will not be responsible for any claimed damages, monetary losses due to you using your email to conduct business in any form or manner, including bids of any sort or any form of business transactions whereby you may be using your email to conduct your business.
WebBusiness wishes to emphasize that in agreeing to this Agreement, customer indemnifies Web Business for any violation of the Terms of Service that results in loss to WebBusiness or the bringing of any claim against WebBusinesss by any third-party. This means that if WebBusiness is sued because of a customer or a customer of a customer's activity, the customer will pay any damages awarded against WebBusiness , plus all costs and attorney's fees.
Web Business is not responsible for the content of any other websites linked to the WebBusiness Hosting servers. Links are provided as Internet navigation tools only. WebBusiness Hosting disclaims any responsibility for any such inappropriate use and any liability to any person or party for any other person or party's violation of this policy.
WebBusiness shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from our servers going off-line or being unavailable for any reason whatsoever. All damages shall be limited to the immediate termination of service.

Full backups are made weekly, and backups of new/changed data made nightly. No guarantees are made of any kind, either expressed or implied as to the integrity of these backups. Backups are made for server restoration purposes only. It is the client's responsibility to maintain local copies of their web content and information. If loss of data occurs due to an error of WebBusiness, WebBusiness will attempt to recover the data for no charge to the client. If data loss occurs due to negligence of client in securing their account or by action of the client, WebBusiness will attempt to recover the data from the most recent archive for a minimum $50.00 fee.
Regular Hosting Clients - Should you become unsatisfied with our services within the first 30 days of your account activation, Web Business Hosting will refund your hosting fee. Note: If you signed up for Plan 2, you will only be refunded for the hosting fee and not the domain name.
A. Legal Parameters: This service may only be utilized only for lawful purposes, and the usage of the service in connection with or adjunct to any matter or thing which violates any municipal, state or federal statute or regulation is prohibited. Customer agrees to indemnify and hold harmless WebBusiness from and against any all claims, actions, causes of actions, losses or damages (including legal fees) arising from the usage by Customer of the service in violation of this paragraph.
B. Unilateral Service Revocation: In the event that WebBusiness may at any time believe that the service is being utilized by the Customer in contravention with the terms and provisions of Item A above, WebBusiness may immediately discontinue such service to Customer without liability other than the refund of unearned prepaid service fees.
With respect to the service to be provided hereunder, Customer acknowledges that WebBusiness makes absolutely no warranties whatsoever, express or implied. As a result, Customer agrees that WebBusiness shall not be liable to Customer for any claims or damages which may be suffered by Customer, including, but not limited to, losses or damages resulting from the loss of data as the result of delays, non-deliveries or service interruptions caused by the fault or negligence of WebBusiness.
The utilization of any data or information received by Customer from the utilization of the service to be provided by WebBusiness is at Customer's sole and absolute risk. WebBusiness specifically disclaims and denies any responsibility for the completeness, accuracy or quality of information obtained through the services to be provided hereby.
Invoicing for web site will be billed a minimum of one (1) months in advance or annually with payments of the service fee for through the end of the 1-month or annual period due upon inception. In the event that Customer shall fail to pay for such services in advance of that 1-month period or annually, then WebBusiness shall be entitled to unilaterally terminate or suspend hosting services. WebBusiness may discontinue or suspend service to Customer until payment is made. Any service disconnection or suspension shall require a $35 re-connect fee.
.Customer understands that renewal will occur automatically at the end of this period under the same terms, unless WebBusiness receives express written notification of cancellation 15 days in advance of the renewal date, and that Customer is responsible for any all fees asses due to Customer's failure to notify WebBusiness of cancellation.
All support inquiries are to be initiated via email to: support@webbusiness.com. WebBusiness will make a diligent effort to resolve any problems related WebBusiness hardware or supporting software immediately. Only after all email inquiries have failed, will WebBusiness provide support via telephone.
Customers support inquiries are handled on a first come, first serve basis.
WebBusiness reserves the right to make changes to the above terms and conditions of the agreement. Changes in monthly service fees being effective only at the end of any calendar quarter for which Customer has prepaid. Utilization of the service by the Customer following the effective date of such change shall constitute acceptance by Customer of such change(s).
This instrument constitutes the entire agreement between the parties, and represents the complete and entire understanding of the parties with respect to the subject matter of this agreement. This instrument supersedes any other agreement or understanding between the parties, whether written or oral. In the event that any term or provision of this instrument is held by a court of competent jurisdiction to be unenforceable, then the remaining provisions of this instrument and the agreement, which it evidences, shall remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto, intending to be legally bound hereby, and in consideration of the covenants and agreements contained herein, do hereby execute this instrument, with each party warranting their ability to enter into this agreement for the person or entity herein named as a party hereto.
